These Terms of Use ("Terms") constitute a legally binding agreement between you and Better Ranch Manager ("we", "us", "our") governing your use of the Better Ranch Manager application ("the app"). By downloading, installing, or using the app, you agree to be bound by these Terms. If you do not agree, do not use the app.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, solely for your personal or internal business purposes. You may not: (a) copy, modify, or distribute the app; (b) reverse engineer, decompile, or disassemble the app; (c) make the app available over a network where it could be used by multiple devices at the same time; (d) sublicense, lease, lend, or rent the app to any third party; or (e) use the app for any unlawful purpose.
The app, including all content, features, design, and code, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding. You retain ownership of all data you enter into the app (ranch information, animal records, photos, notes, etc.). We do not claim any ownership over your content.
You must create an account to use the app. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to create an account. You agree to provide accurate and complete information when creating your account.
The app offers optional auto-renewable subscription plans. Subscriptions are billed through your Apple App Store or Google Play account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your device's account settings. Prices are subject to change. We are not responsible for any charges incurred through your app store account.
You agree not to: (a) attempt to gain unauthorized access to other users' data or accounts; (b) use the app for any illegal, fraudulent, or harmful purpose; (c) interfere with or disrupt the app's operation, servers, or networks; (d) transmit any malware, viruses, or harmful code; or (e) harass, abuse, or harm other users.
When you invite others to your ranch, you grant them access to view and manage data based on the role you assign. You are solely responsible for managing access to your ranch and the actions of users you invite. When you join another user's ranch, you agree to use their data responsibly and only for its intended purpose.
You are solely responsible for maintaining backups of your important data. While we take reasonable measures to protect your data, we do not guarantee against data loss and are not liable for any loss of data for any reason.
You may delete your account at any time from the Settings screen in the app. Account deletion permanently and irreversibly removes all your data, including ranches you own and all associated records. Active subscriptions must be canceled separately through your device's subscription settings to avoid further charges.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE APP AT YOUR OWN RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF LIVESTOCK RECORDS, OR LOSS OF BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED FIFTY DOLLARS ($50.00) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS LESS.
You agree to indemnify, defend, and hold harmless Better Ranch Manager and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of the app, your violation of these Terms, or your violation of any rights of any third party.
You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce and sanctions programs maintained by the U.S. Treasury Department's Office of Foreign Assets Control. You represent that you are not located in, or a resident or national of, any country subject to U.S. trade sanctions.
These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the app shall be resolved exclusively in the state or federal courts located in Oklahoma County, Oklahoma. You consent to the personal jurisdiction of such courts.
We may terminate or suspend your access to the app at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the app ceases immediately.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Better Ranch Manager regarding the app and supersede all prior agreements and understandings.
We reserve the right to modify these Terms at any time. We will notify you of material changes through the app or by email. Your continued use of the app after such changes constitutes acceptance of the updated Terms.
